Genesis Energy Limited welcomes the opportunity to provide a submission to the Ministry of Business, Innovation & Employment on the "Targeted Review of the Commerce Issues Paper" ("Issues Paper")." dated 17 November Reviews of the Commerce Act We carry out periodic reviews of the Commerce Act to ensure it reflects modern regulatory practice and continues to deliver benefits to New Zealanders.

The Commerce Act is New Zealand's generic competition law. It also provides economic regulation of goods or services in markets with monopoly characteristics. Section 36 of the Commerce Act (CA) seeks to prevent firms with substantial market power from engaging in conduct that prevents other firms from competing on their merits, while ensuring that large or powerful firms are not prevented or discouraged from engaging in fierce competition themselves.

Part 4 of the Commerce Act provides for the regulation of the price and quality of goods or services supplied in markets with monopoly characteristics. Part 4 was comprehensively reformed in to improve clarity, certainty, timeliness and. The Ministry of Business, Innovation an d Employment (MBIE) has today released an issues paper entitled “Targeted Review of the Commerce Act ” seeking feedback by 9 February on a potential competition law reform (the Issues Paper).Specifically, MBIE is seeking targeted feedback on: the misuse of market power provisions (section 36 of the Commerce Act).
